1. Acceptance of Terms

By accessing and using Wesker ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms constitute a legally binding agreement between you and Wesker (operated by Emina Technologies).

2. Description of Service

Wesker operates as an online marketplace intermediary connecting independent hardware creators ("Sellers") with buyers ("Buyers"). Wesker facilitates these transactions with automated deterministic pricing, verified machine fleets, and milestone escrow management.

3. Seller Responsibilities

Sellers are entirely responsible for the quality, safety, and legality of the hardware they produce and sell. Sellers must comply with all applicable local laws, including hardware safety certifications, consumer protection, and taxation laws (CGST/SGST/IGST and TCS Section 52). Sellers warrant that their products do not infringe on any third-party intellectual property rights.

4. Buyer Responsibilities

Buyers understand that they are purchasing experimental, custom, or precision-machined hardware. Buyers must inspect all specifications and warnings provided by the Seller prior to releasing escrow via the 6-digit delivery OTP.

5. Payments, Escrow and Fees

Wesker collects payments securely on behalf of the Seller. Funds are held in RBI-compliant Cashfree Escrow and released to the Seller upon successful 6-digit OTP delivery confirmation or after the designated dispute window has expired. Wesker deducts a transparent platform commission and statutory TCS prior to payout.

6. Dispute Resolution & SLA

In the event of a quality defect or specification deviation, Buyers must open a dispute ticket within 7 days of delivery. Wesker provides a structured evidence mediation portal with strict 24-hour compliance response SLAs. If escalated, Wesker holds final authority to issue refunds or release funds based on dimensional CMM and photographic evidence.

7. Prohibited Items

The following items are strictly prohibited from being listed or fabricated on Wesker:

  • Weapons, firearms, or explosive devices
  • Hardware designed to bypass security measures (e.g., skimmers, jammers)
  • Medical devices lacking proper statutory regulatory approval
  • Counterfeit goods or items infringing on third-party CAD copyright or trademarks

8. Limitation of Liability

Wesker acts as an intermediary protected under Section 79 of the Information Technology Act, 2000. To the maximum extent permitted by law, Wesker shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from custom parts fabrication.

9. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of significant statutory changes via email or in-app notifications. Continued use of the platform constitutes acceptance of modified terms.
